
Employers may be held potentially liable for employees who operate an electronic device (hand-held cell phone, MP3 player, laptop, or GPS unit) while driving a company-owned vehicle or driving on the job. To limit their liability, employers should develop guidelines addressing this issue and strictly enforce compliance.

Schwartz Kelly, LLC recently won a major victory on behalf of its client Hobart Brothers Company, an Illinois Tool Works (www.itw.com) company. The Appellate Division ruled that Hobart Brothers could maintain its insurance coverage action against AIG company National Union Fire Insurance Company of Pittsburgh, PA, despite the fact that Hobart Brothers had filed and settled an earlier insurance coverage lawsuit. Although the trial court had ruled against Hobart Brothers, the Appellate Division agreed with the arguments presented by Schwartz Kelly, LLC and reversed and remanded the case back to the trial court for a full decision on the merits.
