Answer: “Can I fire my employee today?” In today’s litigious climate, employers are keenly aware that terminating an employee may result in a lawsuit. Although most employees are “at-will” employees, employers worry about the impact that may flow from separating the employee. Indeed, employees often challenge terminations asserting that their firing was due to discrimination, retaliation, breach of an implied or express contract, or violation of a public policy.
